Terms of Service

These Terms of Service ("Terms") govern your use of the Vagaiyara mobile application ("App") and the website at vagaiyara.com (together, the "Service"). The Service is operated by Navaneethan K, a sole proprietor based in Coimbatore, Tamil Nadu, India ("Vagaiyara", "we", "us", "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years old to create an account.
• You confirm that the information you provide is accurate and belongs to you.
• Where you add or invite other people (including as relatives, event guests, or matrimony matches), you confirm you have their permission or a reasonable expectation of consent.

2. Accounts and identifiers

• Your account is identified by your Indian mobile number and a public handle (e.g., @yourname).
• You may create multiple profiles under the same mobile number (for example, family members who share a device). All profiles under one number share the same password by design.
• You are responsible for keeping your password confidential and for all activity on your account. Notify us at [email protected] if you suspect unauthorised use.
• Handles are unique. We may reclaim a handle that impersonates another person or brand.

3. Content you provide

You retain ownership of the content you upload (photos, messages, profile information). By uploading, you grant us a limited, worldwide, royalty-free licence to store, display, transmit and process that content solely to provide the Service to you and the people you share it with.

4. Acceptable use

You agree not to:

• Create a profile using false identity, another person's photos, or on behalf of a person without their consent.
• Harass, stalk, threaten, or send unsolicited sexual content to any user.
• Use the matrimony feature for solicitation, prostitution, dowry demands, or any other purpose prohibited by Indian law.
• Collect information about other users without their consent, or scrape/automate the Service.
• Post content that infringes intellectual property, is defamatory, discriminatory, obscene, or unlawful.
• Interfere with the Service's operation or attempt to bypass rate limits, access controls, or paid-feature gates.

Violations may result in immediate account suspension or termination without refund. We may report criminal activity to law enforcement.

5. Family graph and verified relationships

Relationships you add require the other person to confirm the relationship. Removals may require confirmation from both endpoints. The graph is not proof of a legal or biological relationship; it reflects only what users have mutually attested to on the Service.

6. Matrimony feature

• The matrimony feature is available only to users who have opted in and who are eligible (18+, marital status Single / Divorced / Widowed / Awaiting Divorce).
• Information you share in your matrimony profile — including horoscope, religion, community, occupation and income band — is visible to other users of the matrimony feature according to your privacy settings.
• We do not verify claims made in matrimony profiles beyond phone-number ownership. Users are responsible for their own due diligence before proceeding to marriage.
• Certain matrimony features (unlimited interests, chat with matches) require an active paid subscription.

7. Payments and subscriptions

• Paid subscriptions are billed through Razorpay. Prices, trial periods, and billing cycles are shown in the App before purchase.
• Subscriptions renew automatically at the end of each cycle unless cancelled at least 24 hours before the renewal date.
• Refunds are provided only where required by applicable law or at our sole discretion. Contact [email protected] for refund requests.
• Applicable Indian taxes (GST) are included in the displayed price where required.

8. Third-party services

The Service uses Google Firebase (authentication, messaging, notifications), Cloudflare R2 (media storage), Razorpay (payments), and standard cloud infrastructure. Your use of the Service is also subject to the terms of these providers as they apply to end users.

9. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, if we are required to do so by law, or to protect the safety of other users. You may terminate your account at any time via Delete account or from within the App.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that it will meet your matrimony or social outcomes.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to your use of the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim, or (b) ₹5,000. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or interpersonal outcomes.

12. Indemnity

You agree to indemnify Vagaiyara from any claims, losses, or expenses (including legal fees) arising from your content, your use of the Service, or your breach of these Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts at Coimbatore, Tamil Nadu.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified within the App and via the "Last updated" date above. Continued use after changes take effect constitutes acceptance.
